What does New York require of you when you move to Florida?

New York taxes you as a resident until you show you gave up New York as your permanent home, and it wants your plates back before the insurance ends.

The Department of Taxation and Finance says your New York domicile does not change until you can demonstrate that you have abandoned it and set up a new one outside the state. A person has only one domicile. The department's Nonresident Audit Guidelines, issued by its field audit bureau, name five primary factors for deciding where a person is domiciled: home, active business involvement, time, items "near and dear," and family connections.

Keeping a place in New York brings a second test. If you keep a permanent place of abode there for substantially all of the year and spend 184 days or more in the state, you are a statutory resident and taxed as one, whatever your domicile. Any part of a day counts as a day. A home your spouse owns or leases usually counts as your place of abode; a vacation structure not suitable for year-round use does not.

In the year you leave, you are a part-year resident and file Form IT-203, the Nonresident and Part-Year Resident Income Tax Return. In later years, a nonresident who receives income from New York sources files IT-203 again.

For many retirees the tax saving is smaller than expected. New York does not tax Social Security benefits. Pensions from New York State, its local governments and the federal government, including the state and city teachers' retirement systems and military pensions, are subtracted at any age. People 59 1/2 or older for the whole year may also exclude up to $20,000 of other pension and annuity income, and the 2025 instructions say that includes IRA payments and periodic 401(k) distributions. Each spouse with pension income has a separate $20,000 limit. A retired teacher living in New York on a New York pension and Social Security owes New York no income tax on either.

The DMV sets an order for the car. You must surrender your New York plates and registration before you cancel the New York liability insurance. If the coverage lapses first, the DMV suspends the registration and may suspend your driver license, even after you move, and that can affect your license in your new state. To surrender, mail the plates with form PD-7 in an envelope, not a box, to NYS DMV, 6 Empire State Plaza, Room B240, Albany, NY 12228, or take them to a DMV office; county motor vehicle offices charge $1 to process it. The DMV mails a receipt, form FS-6T; allow 21 days. If your insurance already changed, mail a copy of your out-of-state registration and insurance to the Financial Security Bureau, New York State DMV, P.O. Box 2725 ESP, Albany, NY 12220-0725.
