Voters approved medical marijuana in 2016 with 71 percent of the vote. In 2024 an amendment to allow recreational use by adults won 55.9 percent, short of the 60 percent a change to the state constitution needs. A new recreational amendment aimed at the November 2026 ballot did not qualify: the state said on February 2, 2026 that it had fallen short of the signatures required, and the Florida Supreme Court dismissed its review two days later. Without a card, having 20 grams or less is a first-degree misdemeanor and more than 20 grams is a felony. With a card, you may buy only from a state-licensed medical marijuana treatment center, and the law still bars using it in any public place, on public transportation, in a car or boat, or on school grounds, and bars smoking it in an enclosed indoor workplace; the one exception in public is low-THC cannabis in a form that is not smoked. Florida does not accept medical cards from other states, and marijuana is still illegal under federal law.
